Terms of Service

1. Service Description

Usetix is a ticketing platform operated by Screen Island GmbH that enables event organizers ("Organizers") to create, sell, and manage tickets for their events. Usetix provides the technical infrastructure for ticket sales and does not organize events itself.

2. Contractual Relationships

Important: The purchase contract for tickets is concluded exclusively between the Organizer and the ticket buyer ("Attendee"). Usetix acts solely as a technical service provider and is not a party to the ticket purchase contract.

Usetix is not responsible for:

  • The event itself, including its execution, cancellation, or quality
  • Claims between Organizers and Attendees
  • Refund decisions made by Organizers
  • Any disputes arising from event attendance

3. Fees and Payment

Usetix charges a fee of 1 EUR per sold ticket. This fee is earned at the time of sale and is non-refundable, regardless of:

  • Subsequent refunds issued by the Organizer
  • Chargebacks or payment disputes
  • Event cancellation
  • Any other reason for ticket invalidation

Payment processing is handled by Stripe and PayPal, depending on the payment method chosen at checkout. Their fees are separate from Usetix fees and are subject to each provider's own terms and pricing. Usetix has no control over these fees and does not receive any portion of them.

All prices for Organizers are exclusive of statutory VAT. Individually agreed terms, such as a different ticket fee or a monthly platform fee, take precedence over these Terms. Usetix bills its fees monthly and provides the invoice in the organizer account.

4. Usetix Credit

Usetix Credit is a balance in the organizer account. The Organizer tops it up in advance, manually or automatically. Credit pays for services Usetix charges by use, in particular the Usetix fee for sales through PayPal, emails to Attendees, newsletters and confirmed table bookings. The prices shown in the organizer account apply.

Credit that has been used is not refunded, including when the Organizer later refunds an order or a booking is cancelled. Topped-up credit does not expire while the organizer account exists. It is not paid out and cannot be transferred to another account. Any remaining balance lapses when the organizer account is deleted.

5. Promoter +

Promoter + is a paid add-on for Organizers, including guest list links for promoters, the promoter app with push notifications, a door list and contacts from guest lists. The booking page describes its exact scope.

Booking and term. The owner of the organizer account books Promoter + in the account. The contract starts with the booking and runs for one month at a time. It renews for another month unless cancelled by the end of the current month. The owner can cancel at any time in the customer portal or by message to Usetix, effective at the end of the paid month. There is no free trial.

Price and payment. The monthly price shown at booking applies, plus VAT. It is due in advance for each month. Payment is made through Stripe, for example by card. Usetix creates the invoices through Stripe and sends them by email. Usetix may change the price with at least six weeks' notice by email, effective at the start of a new month. The owner may cancel before then.

Late payment. If a payment fails, Stripe retries it over the following days and sends an email reminder. If payment is still not made, Usetix may end Promoter +. The guest list links then close. The data stays in the organizer account.

Included credit. For each paid month, Usetix adds Usetix Credit worth 100 in the currency of the organizer account, so 100 EUR for an account in euros. This credit is used before topped-up credit and is valid until the next month's credit is added. Whatever is left then lapses, as it does when Promoter + ends. Included credit is not paid out, refunded or transferred. What is paid with included credit is covered by the monthly price and is not charged separately.

Activation by Usetix. Usetix may switch Promoter + on without a booking, for example for testing or while it is only available through a waitlist. Such an activation is free, comes without included credit, creates no entitlement and can be ended at any time. There is no entitlement to be admitted from the waitlist.

Promoters. Promoters use the promoter app with their own Usetix login. The Organizer decides whom to accept as a promoter and is responsible for its arrangements with its promoters, for example on pay or free tickets. Usetix is not a party to these arrangements.

6. Partner Referrals

Usetix recommends partners from its network to Organizers, for example security services, venues, artists and DJs, sound and light, catering, photo and video or event staff. The Organizer asks for a partner in the organizer account, and Usetix proposes partners it considers suitable.

Free for Organizers. Asking for and receiving recommendations is free for the Organizer. For orders that come from an introduction, the partner pays Usetix a commission.

Introduction. Usetix passes the request and the Organizer's contact details (name, email address, the phone number if given, and the name of the organizer account) to a partner only when the Organizer chooses to meet that partner. The partner uses them to contact the Organizer and make an offer.

Contracts with partners. A contract for a partner's services is concluded directly between the Organizer and the partner. Usetix is not a party to it, does not owe the partner's services and is not liable for their performance, quality, availability or price. Usetix chooses partners with care but does not guarantee that a suitable partner is found or that a partner accepts an order.

Follow-up. After the date of a request, Usetix may ask the Organizer whether an order came about. Answering is voluntary.

7. Service Availability

Usetix reserves the right to modify, suspend, or discontinue the service at any time, with or without notice. While we strive to provide reliable service, we do not guarantee uninterrupted availability.

We may terminate or suspend access to our service immediately, without prior notice, for any reason, including breach of these Terms.

If Usetix discontinues or ends a paid service such as Promoter + through no fault of the Organizer, Usetix refunds the price for the paid period not yet used, pro rata.

8. Organizer Responsibilities

Organizers are responsible for:

  • The accuracy of event information
  • Compliance with applicable laws and regulations
  • Handling customer service inquiries from Attendees
  • Processing refunds when appropriate
  • Maintaining their connected Stripe and PayPal accounts in good standing

9. Data Protection and Data Processing

Where Usetix processes personal data on behalf of the Organizer, in particular data of ticket buyers, guests and team members, the Organizer is the controller and Usetix is the processor. The Data Processing Agreement applies to this processing. It is part of these Terms of Service and is concluded when they are accepted at registration or when an organizer account is set up; no separate signature is required. 10. Limitation of Liability

To the maximum extent permitted by law, Usetix and Screen Island GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Germany.
